11. I understand his disagreement with Wargaming entirely. Wargaming offered no answers to why they have in the past given warnings to other individuals suspected of behavior contrary to the EULA, TOS and rules, and not to him. In addition, they offered no explanation of what evidence they had that he was indeed using bots and not simply being a noob.

    Secondly, not being made sufficiently aware of the rules or any agreement before agreeing to it in most legal circumstances nulls the agreement. If they cannot insure that people have been made aware of the rules, they cannot claim they have agreed to it.

    Thirdly, the terms in which they require you to agree to the EULA, TOS, Rules and privacy agreement renders them also, legally moot, “BY INSTALLING, COPYING, OR OTHERWISE USING OUR GAME(S) OR SERVICE(S) IN ANY MANNER” could be interpreted as downloading data from their servers, or simply browsing their page. It’s effectively the same as if “If you read this you agree to give me all your money unconditionally” is not a legally binding agreement.

    And lastly may I add, FTR’s involvement and agreement to this frankly despicable behavior sickens me, and SS and his accomplices should be ashamed of themselves.

      • It’s just a shame that they don’t seem to catch more of these idle/bot players as it would improve the gamining experience for the other players in the battle.

        I doubt that there are any players out there that are not aware of the fact that using BOTs or third party software breeches the EULA let alone common dfecency. I also doubt that any on-line game allows such things.

        I’m honestly glad that web sites such as this make other players aware that such behaviour in-game is not acceptable.

        Clearly some players, which I presume includes Geekius, think that playing in such a manner is acceptable. Players have to be responsible for their behaviour. If you’re caught doing something illegal accept it and don’t attempt to blame others or deflect attention (my little sister did it). Believe me such behaviour just illustrates what you really are.

        • Not necessarily acceptable, but neither is wargamings treatment of their, as v3ndetta stated, paying customers, which is my point.

          While I do agree with FTR’s attempt to make behavior like this known to be wrong, I do not agree with the way it is being done, which is cruel and unjust to the people who have been punished without first being made aware that it may have harsh consequences.

          Think of it this way.
          1. Player A performs action X.
          2. Player A gets punished for performing action X.
          3. Player B ridicules player A for performing action X, as it is now known that performing action X will get you punished.

          What conclusions can we draw from this? While it is certain fewer people will be doing the same actions that player A did, player A still got ridiculed for an action performed before this action was known to have the result it now has, which is the same reason why laws cannot, in the civilized world, offer retroactive consequences to crimes performed before the law was put in place.

          • Frankly speaking, everyone’s first warning is the EULA/ToS that they HAVE to agree to in order to register an account and play. Subsequent warnings are only courtesy. Whether you spent money or not does not loosen the rules either.

            • And I don’t think you really need to have read the EULA to know botting is forbidden in almost all online game.
              Let’s be honest, the guy knew perfectly well what he was doing was against the rules ,wether he had read them or not.

            If you are talking about the civilized world,civilized person should not done this action in the first place ! He agreed all the terms written on EULA,so as a result he just got punished.He is really lucky enough to get his gold and premium vehicles back,because people like him,will try to find another “easy to get” solution almost infinitely.

            It’s a point of view,i know but he actually got warned when he accepted the rules.Same thing happens on Steam (Vac) protected servers,once you got detected by Vac,you got permaban from all the servers of “X” game.

            Also i want to talk about that too,you are actually using their “software” while playing the game and that means,again you accepted their rules to watch the activity between client and server.The operating system you are using,your graphic card driver (at least Nvidia i know) also reports what’s going on at your system.That’s how they track all these records and try to prevent the piracy.(Note that,Nvidia game experience does not support “cracked games” via using the similiar way.

            Again with the same way they caught EU Super Test leakers (i find that unfair ).So that’s a system which has been used and still using by many softwares,companies and devices.

            Long story short,it might sounds harsh to you but i call it fair (actually many people on this blog and any other will call it fair) Because lots of players investing their time to this game and likely they do not want to be on the same page (team) with a bot and lose their matches.

      I would guess that if they are only suspicious you are botting then you get a warning. If they are absolutely certain then you get a straight ban.

        As I’m certain you realize, 1 is not the case, and 2, while this could be the way in which wargaming discovered it, is at best, illegal in most European countries, which would explain why wargaming is so reluctant to offer any explanation on the methods used to discover the botting software.

        While remaining within legal bounds, the best wargaming could do would be an educated guess, which I believe within any individuals reasoning, would be dealt with with a harsh warning or a slight punishment. (fined credits/xp/gold/premium days etc.)

                • I would figure it wouldn’t be particularly hard to put in something that could detect weather or not commands were coming from an actual keyboard and mouse or gamepad, or if they were coming from “nowhere” (i.e. a bot).

        • Educated guess? WG sure has bot behavioral patterns of the bot programs mapped and all they need to do is to analyze a bunch of replays of suspected player to search for those patterns. Judges ain’t retards, such evidence surely would be hard enough.

          • Correlation is not causation. If I were to try, I could act like a bot for 14.4k games as well without problem, it is safe to say its possible, and plausible behavioral patterns could indicate something without it actually being the case. While something seems like the truth, it doesn’t mean its necessarily correct.

          1) All game relates items, such as tanks, accounts and services, belong to Wargaming and not to players. You are merely renting the data and time you spend in their world, they can take any and all actions they feel are correct.

          2) The act of accepting the EULA signifies that you read and understood it. In any legal document, the defense “I didnt know what I was signing doesnt work because you are explicitly told to read it before signing. Not reading it is not a defense.

          3) since you are the challenging party in this argument, it falls to you to provide counter arguments and proof that WG acted wrong and inconsistent. I want sufficient first party links and documentation. If you are unable to provide the required proof, you are no better than other people who argue “he is a botter and fuck him” and your opinion will be held with the same level of disinterest.

          Finally, you are a fuc ing troll and worthless loser. This opinion is my own and represents only my thought process.

Homer_J offered a very good explanation which is rather probable, however I’m still not certain how wargaming could be absolutely sure that the player is indeed botting and aware that this may have negative consequences for him.

                that’s what i think he deserved. actually i’d be more for a permanent IP ban as well if that wasn’t so easy to get around nowadays.

    • There is a simple reason why they didn’t issue a warning here (and i hope they will never warn a botter again): If it gets known, that botting leads to a warning and only after that to a ban/whipe, i would consider botting my third account. Why? Simple: I let it bot to Tier X and as soon as i get a warning i stop. So warning doesn’t do any good in fighting bots and botters.
      If people know that botting leads to immediate ban/whipe, this scenario is avoided.

      However i consider giving warnings to little kids just idling around all day a valid method to tell them to play more active. Or do i need to remind you that the “idle/afk” banning rules do not only include botters but also people who are just really bad. I think issuing a warning is the right move here since the goal is to improve their play (reduce their idle time).

      tl;dr: Ban botters without warning = good, ban bad players without warning = bad.

    They just shot themselves in the foot with that. Beeing that he bought GOLD to get ACCESS to all that FREE XP, they have to either give him BACK that XP or the GOLD he spent to get it. They are luck this guy is not in the US because they would be headed to court even as we speak.

The balance between what if would cost to fight this case vs what it cost to dismiss it will ALWAYS tip in the plaintiff’s favor, particualrly in the case of a vidoe game. Ever hear the term “nuisance lawsuit”?

        • Legal precedent has all ready been set in the US for full account wipes of bots. Game companies have even been successful against the bot companies themselves. Google Blizzard’s wow for the details.

          While he could certainly take them to court he’d have no chance of winning. The only result would be a hefty counter-suit. Like Blizzard WG could afford to actually go after him with much better lawyers….

It was taken off the bot forum and posted by a known botter who got caught! What’s shameful is your attempt to defend him as a noob or to speak about his rights or how he deserved a warning. Bots should just be banned. He’s lucky they even gave him a second chance.

    No game company is going to provide details of how you got caught. Giving details merely allows the bot developers to correct the flaws in their program. DCs are another silly point. WG can see when you actually are DCing. So it’s not a defense. As far as the rules it’s your duty to read them before you play the game. Especially one that you are spending your money on….

    It’s simple he broke the rules and got caught. Personally I’m saddened that it takes them so long to catch them and wipe/ban them. Hopefully this will be improved in future!

26. So sad, there are so many idiots in this game… On the one side, there are guys like this one…They want all high tiers at the moment so they use bot to unlock them…Why??? Playing tier by tier is gaining experience and skill needed to play higher tier..I can not imagine begining with Ferdinand against another tier VIII players.. the lack of skill would be so painfull, much more painfull than grinding Char B1 or another weak-gunned tank.
    On the oposite side, there are statwhores with far far more battles in Type 59 or KV-1S or another OP than any other tank, jerking off above their high stats and insulting other players. Its so sad..why some people just cant play and have fun??????

      • I have fun on most grinds. :P I just adjust my playstyle. NOTHING is more satisfying than doing 2,000 damage in your stock IS-2 and losing the game. It’s HILARIOUS!

I am currently grinding french heavy line so i am back to those lower tiers and sometimes its very hard to tell the difference between standard braindead person and bot though… But i must say that the quality of that T-54 video surprised me considerably, it was perfectly average play.. which is sad..

    I saw this earlier and the forums is full of little whining, cheating shitbags – one of them was complained about this blog – FTR – revealing how to spot a bot, what to do about it and the mod that highlights bots. The twat was incandescent with rage – it was quite amazing to read. Like the real problem is revealing cheats.

    I also noticed that TankLeader costs 25 Euros and the individual needs a Prem account – so there are many, many awful people who have too much money and no morals…like the financial sector.

    • I was reading their support forum and was laughing at that low life that was demanding that the developers “fix” the problems that allow the bot to be discovered.

30. Although I am happy that a bot was banned I feel the way staff treat the situations are slightly unfair but that is only because I got VAC banned from MW2 back in the day and didn’t hack or modify any files ever. I hope others learn from this.

36. I had a similar situation with wargaming. While they were whining I opened second acc, grinded all I had on my previous acc and told them that I have unlocked my acc :) :) :)

    If you have a will, you can probably go into war with them and win in court, but that is a waste of time, but it’s very funny when support starts crying and threatening because you “got” them. I wrote that I will continue writing to support until I get my acc unlocked, and I got tears and harsh words from support :) :) :)

      He got banned for botting, so his answer was to earn all the progress again while wasting his time e-mailing people whose job to tell him to go fuck himself (and they get paid for it!!!).

    Sometimes i got DCs probably because my internet provider, and in my first 10000 battles i had an average ping of 200, still i had better stats than this botter had.

    And i found this in his profile: “Player is not icluded in overall Hit Ratio rating: less than 3000 shots fired.”
    thats average 4.82 shots per battle…

46. Thanks SS for letting us know that botters get caught and punished. For me, it’s very good news.

    BTW I have bad equipment too (PC freezes from time to time, I guess VGA is going to silicion hell), which leads to inactivity or bot-like behaviour (as my platoonmates refer to me) – the tank is locked in last action when the PC crashes so it goes straight lines, bumping obstacles or allies etc. but I never received a warning (and it happened at least hundred times during my 17k battles). So I guess that WG performs some software checks to tell botters and other ‘strange’ behaviour apart.
